These Terms and Conditions apply to all in-person training courses (“Courses”) provided by:

2. Scope

These Terms govern the booking, payment, participation, cancellation, and related conditions for all Courses delivered in person at our facilities.

These services are considered fixed-date training services with limited capacity.

3. Eligibility

Participants must be 18 years or older at the start date of the Course. We reserve the right to request identification and refuse participation if this requirement is not met.

4. Booking and Formation of Contract

A booking is only confirmed once payment has been successfully received.

Participants may choose between:

• Full payment upfront, or
• Split payment (50% / 50%)

For split payments:

• The first 50% confirms and reserves the place.
• The remaining 50% must be paid no later than 45 calendar days before the Course start date.

Failure to complete payment by the deadline may result in cancellation of the booking without refund of amounts already paid.

5. Reservation Fee (Deposit)

The initial 50% payment is considered a reservation fee that secures a limited place in a scheduled Course and covers administrative and planning costs.

Due to the reserved nature of the Course capacity, this reservation fee is generally non-refundable.

However, this does not affect any mandatory rights granted to consumers under applicable law.

6. Cancellations by the Participant

Participants may cancel under the following conditions:

• 45 days or more before Course start date:
  Refund of amounts paid minus the reservation fee (50%).
• Less than 45 days before Course start date:
  No refund will be issued.

All cancellations must be submitted in writing via email.

7. Rescheduling and Transfer Policy

Each participant may request one (1) rescheduling of their Course date, provided the request is made at least 45 days before the original start date, subject to availability.

Participants may also transfer their booking to another person at no additional cost, provided the new participant meets eligibility requirements and we are notified in advance.

8. Cancellation or Changes by Us

We reserve the right to cancel, reschedule, or modify a Course in the event of circumstances beyond our reasonable control or operational necessity, including but not limited to:

• Insufficient number of participants
• Instructor illness or unavailability (force majeure)
• Technical, safety, or operational issues
• Any situation that may compromise safety or proper delivery of the Course

Minimum Enrollment

If the minimum number of participants is not reached, we may cancel the Course up to 15 days before the start date. In such cases, participants may choose:

• Full refund of all amounts paid, or
• Transfer to an alternative Course date (subject to availability)

Safety Interruptions

We may suspend or terminate a Course immediately if safety conditions require it.

In such cases, participants will receive a pro-rata refund for the undelivered portion of the Course, unless they accept rescheduling.

9. Health, Safety, and Equipment

Courses take place in an industrial environment involving machinery.

We provide all necessary tools, materials, and equipment.

Participants must strictly follow all safety instructions. Failure to comply may result in removal from the Course without refund.

10. Refunds

Where applicable, refunds will be processed using the original payment method within a reasonable timeframe.

Except where required by law or explicitly stated otherwise, the reservation fee covers place allocation and preparation costs and is not refundable once the place has been confirmed.

 

11. Consumer Right of Withdrawal (EU Law)

As this is a fixed-date leisure and training service with limited capacity, the right of withdrawal under EU Directive 2011/83/EU may not apply in full once the booking is confirmed for a specific date and capacity is reserved.

By completing the booking, the participant expressly acknowledges and agrees that:

• The Course is scheduled for a specific date
• Capacity is limited and reserved upon booking
• Performance may begin within the withdrawal period with the consumer’s consent where applicable

Where the right of withdrawal applies and has not been waived, it is 14 days from contract confirmation.

This clause does not affect mandatory consumer rights under applicable law.

12. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, including travel costs, accommodation, or loss of income.

Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability that cannot be excluded under applicable law.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain, and where applicable, European Union consumer protection law.

Any disputes shall be subject to the courts of Catalonia, Spain, unless mandatory consumer law provides otherwise.
